After the presentation we had a few attorneys ask us to suggest language to be included in the Durable Power of Attorney. Below is an example of a clause that could be included:
“Notwithstanding any other provision contained herein, this Power of Attorney does not include the authority to enter into an agreement to arbitrate a health care claim arising under Chapter 74 of the Texas Civil Practice & Remedies Code.”
